South African Copyright Act 98 of 1978
Copyright in South Africa is governed by the Copyright Act 98 of 1978 (as amended). The Act protects certain categories of works and grants the copyright owner exclusive rights to use and authorise the use of those works.
Works eligible for copyright
- Literary works (including computer programs)
- Musical works
- Artistic works
- Cinematograph films
- Sound recordings
- Broadcasts
- Programme-carrying signals
- Published editions
Key provisions relevant to Flash Frequency Productions
- Section 8 — Nature of copyright in cinematograph films: the copyright owner has the exclusive right to reproduce, publicly perform, broadcast, or adapt the film.
- Section 20 — Moral rights: the author retains the right to claim authorship and to object to derogatory treatment of the work.
- Section 21 — Ownership: copyright generally vests in the author, or in the employer if the work was made in the course of employment.
- Section 3 — Duration: for cinematograph films, copyright lasts for 50 years from the end of the year in which the work is made available to the public, or 50 years from creation if never made available.
- Regulation 17 — Inscription of name on cinematograph films: the author's name may appear in any sequence or frame, preceded or followed by the word "copyright", "outeursreg", "kopiereg", the symbol (c), (o), or (k), or the words "all rights reserved" or "alle regte voorbehou".

COPYRIGHT WARNING
The Copyright Act, 1978, governs the making of photocopies or other reproductions of copyrighted material. Under the provisions of the Act, libraries and archive depots are authorised to supply photocopies or other reproductions. One of these provisions is that the photocopy or reproduction is not to be used for any purposes other than private study or personal or private use. If a user makes a request for, or later uses, a photocopy or reproduction for purposes not permitted by the Act, that user may be liable for copyright infringement.
